The State Board of Pardons and Parole has voted to not recommend clemency for Kevin Underwood.

Underwood is scheduled for a lethal injection next week for the brutal murder of 10-year old Jamie Rose Bolin in Purcell in 2006.

Underwood's attorney Brendan Vanwinkle told the panel Underwood has emotional and psychological disorders including autism.

"Undeniably Mr. Underwood's crime was horrible and his actions continue to cause incalculable harm. This board's review considers more than just the crime though. It considers the person along with it," said Vanwinkle.

Aspen Layman with the State Attorney General's office says Underwood does not deserve a reprieve from his death sentence.

"And while we as an enlightened society can give grace to those struggling with mental illness, we can still expect them to refrain from planning the murder, rape, torture and cannibalism of 10-year-old little girls," said Layman.

Oklahoma Attorney General Gentner Drummond reacted after the board voted 3-0 to deny clemency.

“I am pleased the board voted to deny clemency for this deeply evil monster and ensured that justice will be delivered for Jamie Rose Bolin,” Drummond said. “Jamie’s family has waited 18 excruciating years for justice that finally will be carried out when this murderer is executed.

Underwood is scheduled to be executed on Thursday, December 19.
