An Oklahoma County judge has ordered a new trial for a man convicted of killing an Edmond liquor store clerk in 1974. Glynn Simmons will also be released from prison on a Medical OR bond with certain terms and conditions. Oklahoma County District Attorney Vicki Behenna asked the Court to vacate Simmons' murder conviction. She says the State failed to turn over certain police reports as required by law. Simmons and another man were convicted of fatally shooting Carolyn Rogers and wounding a store customer. They both were given the death penalty, but the sentences were changed to life in prison in 1977. Simmons' new trial date is set for October 23rd.
